Enforcement
Enforcement of our rules. In the Netherlands, we have rules governing water and soil. These include laws and decrees such as the Environment Act, the Activities Decree, and the Water Board Regulations. Our employees who are responsible for enforcement check whether companies and individuals comply with these rules. Our employees also provide information about the rules that apply to water and soil. We do this through company visits, newsletters, and presentations. In this way, we aim to prevent violations as much as possible.
What do we do in the event of a violation?
If violations do occur, we request that the offender take measures. For example, cleaning a waterway or repairing a dike. The water board is authorized to impose a penalty and to revoke the permit. We also employ Special Investigating Officers (BOAs). In the event of a violation, they can issue an administrative penalty or a report.
Enforce compliance
In the event of a violation, you can also enforce compliance yourself. You can do this by submitting an enforcement request. This must be submitted to the competent authority, for example the water board. This can be done in writing or by email. The competent authority must process your complaint. It is possible to submit a complaint anonymously. You will receive a response to the enforcement request no later than 8 weeks after submitting it.
Why area-based enforcement?
Area-specific enforcement means that we adapt our supervision and enforcement to the situation in a particular area. We look at the soil, the water, how the land is used, and how much pressure there is on the environment. This enables us to respond better to what is needed in a particular area.
